Using Dash Cam Footage To Prove Fault In An Auto Accident

I was recently shopping on Amazon for Amazon Prime Day and noticed Dash Cams on sale. I began to wonder who was buying Dash Cams for their personal vehicle. After some thought, I realized it makes sense. In many automobile accident cases, liability is disputed. It is your word against the other driver. It could be a matter of who ran the light or who was speeding. The police officer was not present at the time of the accident and may not be able to tell. Have your dash cam footage could help prove you claim.

Dash cams are hooked to your windshield or dashboard and are supposed to show everything the driver sees. Some cameras even record sound. Having an actual recording of the accident itself can be pretty convincing evidence to an adjuster (or jury if a case goes to trial). Of course, the Dash Cam isn’t going to pick up everything. If you were rear-ended, the camera will not be helpful. Sometimes the camera may prove that you were at fault. In contributory negligence states, such as North Carolina and Virginia, a dash cam could help show exactly how much time a driver had to respond to show that he or she could not avoid that accident.

Of course, if you end up at trial, you have the issue of authenticating the dash camera video before it can be admitted as evidence. It must be reliable, accurate and not modified from the date of accident. It is likely the other side will object to your footage, that is why it is important to hire an experienced trial attorney.
