Nowadays, everything we do goes on social media for the world to see. People are even posting pictures of their dinner. However, after you have been injured in an accident, what you say, do and post in public can be used against you. More and more insurance companies are checking the social media accounts of people claiming to be injured in accidents.
In Georgia, a man was rear ended on the Interstate while he was stopped for a disabled vehicle. While the Defendant admitted negligence and admitted the Plaintiff had a head and hip injury, they did not believe the injury was as severe as he was claiming. The case went to trial. While the Plaintiff was on the stand, the defense counsel asked if the Plaintiff had resumed running. The Plaintiff said no. Defense counsel then produced pictures from the Plaintiff’s social media accounts showing him participating in a Spartan Race which is not just a run but also has many athletic obstacles.
So, if you are injured in an accident, be very careful what you post on social media. It is the job of the insurance adjuster to determine if his insured was at fault, if there was an injury and the severity of that injury. They base their settlements on those things. Insurance companies are looking for a reason to deny or reduce your claim or injury. Don’t give them one on social media.
